Seva Spine (“Seva Spine,” “we,” “us,” or “our”) is a 501(c)(3) nonprofit organization based in Atlanta, Georgia, that provides charitable spine care to patients in need in the United States and India. This Privacy Policy describes how your personal information is collected, used, and shared when you visit www.sevaspine.com (the “Site”), make a donation, contact us, or apply for help through the Site.

Personal Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. As you browse the Site, we also collect information about the individual pages you view, what websites or search terms referred you to the Site, and how you interact with the Site. Health Information

Health information you share when applying for help is used only to evaluate your eligibility for assistance and to coordinate your care. We limit access to this information to Seva Spine staff, volunteers, and medical professionals who need it for those purposes, and we share it with the hospitals, clinics, and providers (in the United States or India) who may evaluate or treat you. We will not use your health information for fundraising or publish your story, name, or photos without your written permission (or the permission of your parent or guardian, if you are a minor).

Once you receive care, the medical records created by your treating providers are governed by those providers’ own privacy practices. Please note that email and online forms are not a fully secure way to send medical information. If you prefer, contact us to arrange another way to share your records.

Sharing Your Personal Information

We share your Personal Information with service providers who help us operate the Site and our programs, such as our website host, payment processor, email and form providers, and analytics providers. For example, we use Google Analytics to help us understand how visitors use the Site. As described above, we also share information about patient applicants with the medical providers and partner hospitals involved in their evaluation and care.

Finally, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Your Rights

You may ask us to access, correct, update, or delete the Personal Information we hold about you, or to stop sending you marketing emails, by contacting us using the information below. Every marketing email we send also includes an unsubscribe link. We may need to keep certain information, such as donation records, to meet our legal and tax obligations.

Residents of the European Economic Area and United Kingdom have the right to access personal information we hold about them and to ask that it be corrected, updated, or deleted. We process your information to fulfill our commitments to you (for example, when you make a donation or apply for help), with your consent, or to pursue our legitimate interests described above. Your information will be transferred to and stored in the United States.

Residents of India may, under the Digital Personal Data Protection Act, 2023, request a summary of the personal data we process about them, request correction or erasure, withdraw consent, and nominate another person to exercise these rights on their behalf. Data Retention

We keep donation records for as long as required for tax and accounting purposes. We keep other information you submit through the Site, including patient assistance applications, for as long as needed for the purposes described in this policy, unless and until you ask us to delete it and we are not required to retain it.

We use reasonable administrative, technical, and physical safeguards to protect your Personal Information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Minors

The Site is not intended for individuals under the age of 13.

Collection and Use of Personal Information of Children Under Age 13

We are committed to protecting the online privacy of children. In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we will not knowingly collect any personally identifiable information from children under the age of thirteen (13) without first obtaining parental consent. Because Seva Spine treats patients of all ages, applications for help on behalf of a child must be submitted by the child’s parent or legal guardian. If you believe a child under 13 has provided us with personal information without parental consent, please contact us and we will delete it.

Changes

We may update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. The effective date at the top of this page shows when it was last updated.
